In 1985, in the case of Tennessee v. Garner, the Supreme Court held that a police officer may not shoot a fleeing suspect in the back unless “the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others.” The Court reasoned that the use of deadly force on a fleeing suspect was an unreasonable seizure under the Fourth Amendment. What happened in this video, according the the Supreme Court, was, without a doubt, unconstitutional. Of course the defense will argue that the officer was in fear for his life, but anyone with two eyes can see that is ludicrous. The force was unjustifiable and that was murder.
